Judge in Albany blocks state from enforcing ban on flavored e-cigarettes

The state's ban on the sale flavored electronic cigarettes was not even a week old when a judge in Albany blocked it from being enforced.
The judge ruled that only the state Legislature, and not Gov. Andrew Cuomo, can institute such a ban. Lawmakers are now working on passing the legislation to ban flavored e-cigarettes, while those in the vaping industry are applauding the court ruling.
Matt Flax, who owns Vaporville in Hicksville, argues that flavors have nothing to do with the safety of vaping and blames black market products for health issues and deaths that have occurred among e-cigarette users.
Cuomo said in his State of the State address last week that he wants new state laws that restrict vaping. State Sen. Anna Kaplan, of Great Neck, is sponsoring a bill that would prohibit the advertising of e-cigarettes and liquid nicotine within 500 feet of a school or park.
Separately, Nassau County has a ban on all e-cigarettes that are not tobacco, menthol or mint flavored. It's not clear if the judge's ruling will have any effect on the county ban.
