Analyst: Dulos’ motions to return seized property is a ‘strategy’
The attorney for Fotis Dulos has filed motions asking the court to return property taken by police as part of their investigation into the disappearance of his wife, Jennifer.
Two motions were filed by Fotis Dulos' defense attorney Norm Pattis at the Stamford Superior Court – one motion to preserve evidence and the other to return seized property.
Matthew Maddox, a trial attorney in New Caanan not associated with the case, says while these are common motions in a criminal case, it's also a strategy.
"The state and courts know that the defense is aggressive, they are not going to sleep while the state does its own work. They have their own work to do," he says.
Maddox says attorneys want to make sure all the evidence is transparent.
According to the motion, his defense attorney says Dulos wants his three cars, computers, two iPhones, a hard drive and other items returned.
Maddox says those devices could be a treasure trove of information, or could have nothing, but he doesn't think the state will turn it over until they have forensically evaluated all the evidence.
“I think it's going to take a long time," says Maddox.
Fotis Dulos and his current girlfriend Michelle Troconis are both charged with tampering with or fabricating evidence and hindering prosecution. They are both free after posting $500,000 bond.
