It's back to square one in the deliberations at the trial of former Nassau County Executive Ed Mangano and his wife Linda after a sick juror was dismissed.

Juror No. 5 didn't show up for day seven of deliberations Tuesday morning, instead faxing a doctor's note and a sick note to the judge.

The defense asked for a mistrial, saying the deliberations were "toxic" and indicated there was cursing and name-calling. The judge denied that motion, and replaced juror No. 5 with one of the alternates.

The alternates have not been inside the deliberating room, and the move essentially puts the jury back to the drawing board.

“The level of acrimony reported by the now-discharged juror was extreme, which we think warranted a mistrial,” said Ed Mangano’s attorney Kevin Keating.

Linda Mangano’s attorney John Carman said that the “intensity in that jury room…doesn’t bode well for a unified verdict.”

The jury will only be deliberating the Manganos' case. The not guilty verdict of Venditto will not be affected by the dismissed juror.
