Man held in prison on murder charge for 3 years returns to court

A man accused in a 2014 murder was back in court Wednesday after being released from prison a month ago without explanation.
Brian Solano listened to the judge set a new court date for him on Wednesday, but he says that's not what he was expecting would happen.
"Today I was hoping for it to get dismissed," he says. "It didn't happen like that."
The reason he thought the charges would be dropped had to do with how he was released from Downstate Correctional Facility in Fishkill a month ago.
After three years in prison for allegedly shooting a 21-year-old man to death in 2014, and with no explanation or previous plan for the 24-year-old's release, he said he didn't understand what was going on.
Solano says after three hard years behind bars that left him with scars on his face, he was given only khakis, a prison shirt, boots, $40 and a Metro-North card and was sent on his way.
The family's private investigator says the release came only days after he was forced to turn over evidence that he says proves Solano's innocence.
Even with no dismissal Wednesday, Solano's family says at least he's home. Solano says he is also happy to be free, eating his grandmother's cooking again and is excited for his day in court.
Solano's lawyers and the private investigator say they will keep pushing for the case to be dismissed.
Solano is due back in court Feb. 21.
The district attorney's office had no comment on the pending case.
