Appeals court rules former state Senator Velella can remain out jail temporarily

An appeals court has ruled Monday that former state Senator Guy Velella and four others can remain out of jail for at least another two weeks.

The Appellate Division ruling came just hours after a lower-court judge ordered Velella and four others to return to jail by 5 p.m.

Velella was imprisoned for after admitting his role in a lucrative bribery scheme. The Local Conditional Release Commission ruled that Velella and his co-defendants were freed illegally in September after serving about three months of a one-year sentence.

Velella served 18 years as state senator in Westchester and the Bronx.

A full appeals panel will hear arguments in the case on December 16.
