Guy Velella's attorney makes another appeal to keep him out of jail

Former state Senator Guy Velella's attorney made one last attempt Thursday to keep his client from going back to jail.

Velella, who served three months of a year sentence after admitting to bribery charges, was ordered back to jail after the new members of the Local Conditional Release Commission ruled that his early release was illegal. Shortly after that decision an appellate court ruled that Velella could remain out of jail temporarily.

The former senator's lawyer argued before five appellate court judges that the commission does not have the power to send Velella back to jail. He added that his client should not have to pay for the former commission's mistake.

Velella's fate is now in the hands of the judges. Lawyers for the city say a decision may not be made for weeks.

Velella served 18 years as state senator in Westchester and the Bronx and is currently undergoing treatment for prostate cancer.
