Appellate court orders former state Senator Guy Velella to return to jail

A state Appellate Court ruled Monday that former state Senator Guy Velella must return to jail, upholding an earlier court decision that his release was illegal.

Velella's release from Rikers Island has been under scrutiny ever since the former New York City Local Conditional Release Commission let him out of jail after serving only three months of a year sentence for bribery. His lawyer had argued that the commission did not have the power to send Velella back to jail.

The former senator, who served 18 years in the Bronx and Westchester, must return to jail on December 27.
