A lawmaker is calling for the police commissioner and mayor to discipline 43rd Precinct cops who allegedly brutalized a Bronx man in a case of mistaken identity.

State Sen. Rev. Ruben Diaz (D-Bronx) says the city is sending Bronx residents a bad message by failing to suspend the 10 cops in question. The police officers allegedly pulled over Rev. Indalecio Dellvalle last week on the Cross Bronx Expressway, beat him and took him in for questioning. However, Dellvalle says the cops later realized they had the wrong man and apologized.

Dellvalle's attorney says his client was a victim of racial profiling and police brutality. Dellvalle plans to file a civil rights action lawsuit against the city. The NYPD says the brutality claim is under investigation.
